1. Definitions

In these Terms of Use (« Terms »):

  • Application / Service: the RydrWay platform, including the website, application, and related features (route planning, maps, AI generator, GPX export, community, etc.), regardless of the device used.
  • User: any natural person accessing the Service or creating an account.
  • User Content: any content created, imported, published, or transmitted by a User (road trips, stages, comments, images, metadata, etc.).
  • Route: any track, set of stages, distance estimate, duration, elevation profile, or instruction generated or modified through the Service.
  • AI Features: automatic suggestions (routes, POIs, text) produced by artificial intelligence models configured by RydrWay.
  • GPX Export: file or data exported from the Service for use in a third-party application.
  • Publisher / RydrWay / we: the entity identified in Section 2.

These Terms govern access to and use of the Service. They supplement, without replacing:

  • the Terms of Sale, applicable to subscriptions, credits, and paid purchases;
  • the Privacy Policy, applicable to the processing of personal data;
  • the legal notices published on the website.

In the event of a conflict between these Terms and the Terms of Sale regarding a paid service, the Terms of Sale prevail for pricing and purchase-related contractual aspects.

3. Purpose and nature of the Service

RydrWay is a motorcycle road trip planning tool. It allows you to create, view, edit, save, and export routes, access community features, and, where applicable, receive AI-assisted suggestions.

Unless otherwise stated in the interface, RydrWay does not provide real-time turn-by-turn navigation and does not replace the User’s judgment, riding experience, or compliance with traffic laws.

GPX files and other exports are provided for informational purposes only. Use in a third-party navigation application is solely the User’s responsibility and subject to that application’s terms of use.

4. Access conditions

  • The Service is reserved for adult natural persons (18 years of age or older) with legal capacity to contract.
  • The User warrants that use of the Service complies with applicable law in their country of residence and where they ride.
  • The Service is intended for personal use consistent with its purpose. Unauthorized professional or commercial use is prohibited.

5. Account creation and management

Some features require an account. The User agrees to:

  • provide accurate, complete, and up-to-date information;
  • maintain the confidentiality of credentials and limit access to their account;
  • notify RydrWay promptly of suspected unauthorized use (support@rydrway.com);
  • create only one account per person and not share credentials with third parties.

Any action taken from the account is deemed to have been performed by its holder, unless proven otherwise.

RydrWay may refuse registration or suspend or delete an incomplete, fraudulent, or long-inactive account, subject to applicable law.

6. Contract formation

Making the Service or registration form available constitutes an invitation to contract, not a binding offer.

The Service use agreement is formed when the User accepts these Terms (and, where applicable, the Privacy Policy) and RydrWay activates access to the account or relevant features.

There is no right to registration. RydrWay reserves the right to refuse or withdraw access to the Service, subject to mandatory legal provisions.

7. Description of services

Depending on the plan subscribed (free or paid; see Terms of Sale), the Service may include:

  • creation and editing of road trips (stages, route preferences, POIs);
  • motorcycle route calculation via third-party routing engines;
  • map display, elevation profiles, and duration estimates;
  • AI-assisted generation of routes or suggestions;
  • saving, duplicating, and sharing road trips;
  • GPX export and community features (friends, comments, favorites, etc.).

Free plan limits (number of road trips, stages, exports, AI credits, etc.) are those displayed in the interface at the time of use. RydrWay may evolve features available per plan, subject to the Terms of Sale for active paid subscriptions.

8. Permitted use and prohibitions

The User agrees to use RydrWay fairly, reasonably, and in compliance with applicable laws.

The following are prohibited without RydrWay’s prior written consent:

  • automated data extraction (scraping, crawling, harvesting) or use of bots/scripts imposing abnormal load on the Service;
  • any attempt to hack, circumvent security measures, reverse engineer, or gain unauthorized access to code, APIs, or infrastructure;
  • reselling, renting, sublicensing, or making the Service available to third parties;
  • fraudulent use, disruption of the Service, or distribution of malware;
  • account sharing or creating multiple accounts to circumvent usage limits;
  • using Service outputs (maps, routes, data) to train AI models or build public reference databases for commercial or competitive purposes;
  • using the Service for illegal, defamatory, discriminatory, harassing purposes or in violation of third-party rights.

9. AI Features

AI-generated content is produced automatically from parameters provided by the User and available data sources. It is provided for assistance only and may be incomplete, outdated, inaccurate, or unsuitable for the actual situation (weather, closures, rider skill, motorcycle type, etc.).

It does not constitute professional advice or a guarantee of road safety. The User must manually validate every route, stage, and suggestion before use or export.

RydrWay does not guarantee the originality, accuracy, or non-infringement of AI-generated content. The User remains responsible for its use.

10. User responsibility on the road

The User acknowledges that completing a route planned via RydrWay depends primarily on their riding ability, vehicle, equipment, weather conditions, road conditions, traffic, and compliance with traffic laws.

Before and during any ride, the User agrees to:

  • verify the rideability of segments (works, seasonal closures, difficult passages, snow, gravel, etc.);
  • ensure the route is compatible with their motorcycle, experience, and physical condition;
  • verify that equipment (helmet, gloves, protection, tires) is suitable;
  • comply with traffic laws, which prevail over any Service suggestion;
  • not use RydrWay or a GPX export while riding in a manner that violates regulations (distraction, device handling, etc.).

RydrWay does not guarantee the accuracy, completeness, or permanent updating of routes, POIs, elevation profiles, duration estimates, or displayed consumption figures.

11. Map data and third-party services

The Service relies on third-party providers and data sources (notably for routing, mapping, geocoding, authentication, AI, hosting, and payments).

Route calculation may use services such as GraphHopper and map data from OpenStreetMap and other contributors. RydrWay is not the author of this data and does not guarantee its accuracy, completeness, or timeliness.

The User acknowledges that:

  • errors, update delays, or inaccuracies may affect maps, routes, and POIs;
  • access to certain third-party resources may be subject to their own terms;
  • RydrWay is not responsible for the content, availability, or practices of third-party sites or applications accessed via the Service or a GPX export.

Required attributions for data providers are available in the application or on the website.

12. User Content

The User retains ownership of their User Content. They warrant that they have the necessary rights to publish it and that it does not infringe third-party rights or applicable laws.

By publishing or transmitting User Content, the User grants RydrWay a non-exclusive, worldwide, royalty-free license for the duration necessary to provide the Service, to store, reproduce, display, adapt (formatting, thumbnails), distribute to authorized users, and back up such content.

RydrWay is not required to pre-moderate content but reserves the right to remove or restrict access to content that is manifestly unlawful, fraudulent, infringing third-party rights, or contrary to these Terms, without notice when the situation requires it.

In case of a substantiated report of rights infringement (including intellectual property or privacy), the User concerned may contact support@rydrway.com.

13. RydrWay intellectual property

RydrWay and its elements (trademarks, logos, interface, design, software, databases, algorithms, documentation) are protected by intellectual property law.

Subject to compliance with these Terms, RydrWay grants the User a personal, non-exclusive, non-transferable, and revocable license to access and use the Service for its intended purpose.

Any unauthorized reproduction, display, extraction, or reuse is prohibited.

14. Availability and evolution of the Service

RydrWay uses reasonable efforts to ensure Service availability. However, the Service is provided « as is » and « as available », without warranty of error-free operation, uninterrupted access, or fitness for a particular purpose.

Interruptions may occur (maintenance, updates, incidents, overload, force majeure, network or third-party provider failure). RydrWay may modify, suspend, or remove certain features, subject to mandatory provisions and the Terms of Sale for active paid services.

15. Suspension, sanctions, and termination

In case of violation of these Terms, security risk, or request from a competent authority, RydrWay may apply proportionate measures, including:

  • warning;
  • content removal;
  • temporary feature restriction;
  • account suspension or termination.

The User may terminate their account at any time via Service settings or by writing to support@rydrway.com. Simply deleting the app or closing the browser does not constitute termination.

Account termination does not automatically cancel a paid subscription (see Terms of Sale). Before terminating, the User is advised to export data they wish to keep.

Unless required by law or documented legitimate interest (security, litigation), RydrWay may delete account data within a reasonable time after termination, in accordance with the Privacy Policy.

16. Limitation of liability and warranties

RydrWay is subject to an obligation of means in providing the Service.

Within the limits permitted by applicable law, and without prejudice to mandatory consumer protection provisions:

  • RydrWay is not liable for indirect damages (loss of revenue, loss of opportunity, loss of data not backed up by the User, etc.);
  • in case of non-intentional fault, RydrWay’s liability is limited to direct, foreseeable, and typical damages given the nature of the Service;
  • for paid services, total liability may be capped at the amount actually paid by the User for the relevant Service in the 12 months preceding the event giving rise to liability, except gross negligence, wilful misconduct, or bodily injury.

RydrWay is not liable for riding decisions, accidents, traffic violations, or consequences of using GPX exports in third-party applications.

The above exclusions and limitations do not apply in case of death, bodily injury caused by gross negligence or wilful misconduct, or where the law prohibits such limitation.

17. Indemnification

The User agrees to hold RydrWay harmless against any third-party claim, action, or judgment based on User Content they published or use of the Service contrary to these Terms or the law, to the extent permitted by applicable law.

18. Changes to these Terms

RydrWay may amend these Terms for legitimate reasons (Service evolution, legal compliance, security, contractual clarification).

Users with an account will be notified by email or in-app notification at least 15 days before the new version takes effect, except where required by law or urgently necessary for security reasons.

If no objection is submitted before the effective date, the new version is deemed accepted. In case of objection, the User may terminate their account free of charge before the effective date; continued use constitutes acceptance.

The version in force is the one published on the website with its effective date.

19. Governing law, mediation, and jurisdiction

These Terms are governed by French law.

In the absence of an amicable settlement, disputes shall be submitted to the competent courts of Paris, subject to mandatory provisions applicable to consumers (including the consumer’s domicile where the law so requires).

In accordance with the French Consumer Code, consumer Users may use a consumer mediator free of charge. Mediator contact details: [To be completed].

20. Final provisions

  • If any clause of these Terms is held invalid or unenforceable, the remaining clauses remain in full force and effect.
  • Failure by RydrWay to enforce any provision does not constitute a waiver.
  • The User may not assign their rights or obligations without RydrWay’s written consent. RydrWay may assign the agreement in the context of a reorganization, subject to respect for User rights.
  • The French version of these Terms shall prevail. Any translations are provided for information purposes only.
